Gingerpower Web Services do not allow Adult, Warez, illegal MP3 Sites or IRC Bots. Users must not participate in any form of un-solicited bulk e-mailing or spam.
You may not store more data in your account than your allotted server space.
Your server space and ftp account is for your personal use only. You must not divulge the password to any other person, and you should take reasonable precautions to ensure that it is not discovered by other people.
Data stored on our servers is not guaranteed to be backed up. It is recommended that you keep an independent backup of all data stored on your web space unless a specific backup service is negotiated and offered by Gingerpower Web Services for individual clients.
Gingerpower Web Services will not be held liable for any loss or damages caused by the use or misuse, unavailability or removal of services.
When your account is closed, all files (including web pages, etc.) will be deleted.
Gingerpower Web Services reserves the right to cancel your account at any time without notice.
Gingerpower Web Services reserves the right to amend and update these Terms and Conditions at any time without notice.
To protect your privacy Gingerpower Web Services will never distribute your name or e-mail address to any third parties.
By logging into your account, or uploading files to it, you are indicating your acceptance of these Terms and Conditions.
Bandwidth
Bandwidth refers to the amount of visitor traffic is used on your domain, by uploading to and downloading from your site, and by your email traffic. Our Hosting Packages are limited in bandwidth and any excess use will be charged extra.
If you near your bandwidth limit, we will notify you by email. Additional bandwidth will be charged at £5 per Gb.
Web Pages
Commercial use of web and ftp space is permitted.
You will be responsible for the content of your pages, including obtaining the legal permission for any works they include and ensuring that the contents of these pages do not violate UK law.
You will be held responsible for and accept responsibility for any defamatory, confidential, secret or other proprietary material available via your page(s).
We reserve the right to remove material deemed inappropriate from your web pages, without prior notice. Gingerpower Web Services does not allow adult, warez or illegal MP3 web sites on their servers.
Cancellation and Refunds
If you purchase an annual package you are expected to commit for this period of time. If you cancel your account within your service period then Gingerpower Web Services will not make refunds on any unused portions of your account. While we do not offer refunds for pro-rated service (beyond our 30 day money back guarantee which is applicable to annual accounts only) you have no obligation to continue using our service.
Our 30 day money back guarantee (applicable to annual accounts only) excludes the refund of domain name registration fees.
Gingerpower Web Services reserves the right to cancel the service at any time. Customer refund requests are to be sent to support@gingerpower.co.uk and will only be processed in the cases of service non-performance where Gingerpower Web Services is clearly at fault. Refund requests for problems beyond Gingerpower Web Services' control will be refused. (For example: Domain transfer failure, Failure of any third party script or program that's not supported by Gingerpower Web Services.)
Indemnification
Customer agrees that it shall defend, indemnify, save and hold Gingerpower Web Services harmless from any and all demands, liabilities, losses, costs and claims, including reasonable solicitors fees asserted against Gingerpower Web Services, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless Gingerpower Web Services against liabilities arising out of:
(1) any injury to person or property caused by any products sold or otherwise distributed in connection with Gingerpower Web Services' server.
(2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party.
(3) copyright infringement.
(4) any defective products sold to customer from Gingerpower Web Services' server.
Disclaimer
Gingerpower Web Services will not be responsible for any damages your business may suffer, Gingerpower Web Services makes no warranties of any kind, expressed or implied for services we provide. Gingerpower Web Services disclaims any warrantor merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, non-deliveries, wrong delivery, viruses and any and all service interruptions caused by Gingerpower Web Services and its employees.
The Purchasing of Goods
The customer is responsible to Gingerpower Web Services for ensuring the accuracy of any orders.
The customer is responsible for written confirmation of orders placed; any errors made on verbal orders can only be rectified at the customers expense.
The customer indemnifies Gingerpower Web Services in full against all loss (including the loss of profit), costs, damages, charges and expenses incurred by Gingerpower Web Services as a result of cancellation of a order; any such cancellation must be informed to Gingerpower Web Services in writing.
No variation to the Gingerpower Web Services Terms and Conditions of Sale shall be valid unless agreed in writing.
In the event of increased cost to Gingerpower Web Services, we reserve the right to increase prices to reflect this prior to shipment and on informing the customer.
Payment terms
Payment forms currently accepted by Gingerpower Web Services for payment of goods include Transaxed cheque, cash, payment through Gingerpower Web Services' secure paymeny gateway for online payments, or else by means of cleared funds (BACS, TT, CHAPS or Bankers Draft) or deposit of cleared funds in our bank account with shipment only on confirmation from our bank unless pre-arranged withGingerpower Web Services.
Goods supplied on credit will remain the property of Gingerpower Web Services until payment has been made with specific terms agreed. If the customer fails to make on the due date, then without prejudice to any right or remedy available, Gingerpower Web Services will be entitled to:

Cancel the contract or suspend any further deliveries, or suspend any services to the customer.
- Appropriate any payment made by the customer to such of the goods as Gingerpower Web Services may think fit.
- Charge interest at 5% over prevailing base rate on all overdue amounts.
- Recover all costs incurred in case of litigation.
Miscellaneous
Each party shall treat as confidential all information obtained from the other.
These conditions shall be governed by British Law.
Any claims against shall be brought in the English courts. Gingerpower Web Services reserves the right to bring proceedings against you in either the English courts or in the courts of the country in which you are domiciled.

Gingerpower Web Services understands and respects the importance of individual privacy. We are committed to protecting your privacy and safeguarding your personal information.
The Information We Collect
Gingerpower Web Services will not collect any personally identifiable information about you (e.g., your name, address, telephone number, email address & credit card details) through our websites unless you have provided it to us voluntarily. For example, you will be asked to provide personal information when purchasing products from Gingerpower Web Services. Your participation is voluntary and we will not require you to provide more information than is necessary.
How We Use The Information We Collect

We do not keep or store credit or debit card information. The information given, voluntarily by you, is only used to process credit or debit card payments. It is then destroyed and no record kept.

Our web site does not use persistent cookies, which are saved on your hard drive to track you individually as you browse through sites over time. It does use session cookies to collect the information listed above. The session cookies do not track you as an individual. As soon as you quit your browser, the session cookies are deleted. This web site does not use any other cookies.
Our Promise
We do not provide any identifiable personal information to any third party for any purpose whatsoever. Access by our employees and agents to your personal information is only on a need to know basis on the understanding that this is confidential business information.
